Ohio Attorney General Andy Wilson said at a that all 16 children were largely confined to a 12-foot-by-12-foot room inside the home and “looked like almost feral animals.”

In his motion, Stolly is requesting that a “formal evaluation be conducted in order to determine whether [Elizabeth] is competent at this time to stand Trial to the offenses as charged herein.”

He then goes on to request a second evaluation of his client should the judge approve his motion and the first evaluation determine that Elizabeth is fit to stand trial.

That evaluation would be “to determine if she is not guilty by reason of insanity, because she was suffering from a condition which would produce legal insanity at the time of the alleged offenses,” according to the motion.

In a memorandum of support that accompanies his motion, Stolly writes that he has met with Elizabeth “on numerous occasions and for extended periods,” and that he has been able “to observe [her] demeanor, conduct, and comprehension.”

As a result of those interactions, Stolly writes that he believes Elizabeth “may be suffering from significant mental health issues” and that her “competency may be an issue and a clear impediment to [her] ability to assist in her own defense.”

Stolly also notes that because his client has not yet been indicted, he does not have all the “facts, evidence or circumstances” surrounding the case or her arrest.

Elizabeth has given birth to at least 18 children, and delivered twins in each of her last four pregnancies.

She first had twins in February 2022, then , followed again by twins in both January 2024 and January 2025, which was the date of her most recent known birth.

Elizabeth gave birth to the oldest child rescued from the “House of Horrors” when she was just 15, three months after she married a then-18-year-old Gary II in West Virginia.

Stolly has said that he is still working to determine if Elizabeth is a victim in this case.
